Terms and Conditions

1. Guarantee

ENGINO provides a 3-year commercial guarantee for eligible ENGINO products, commencing from the original date of purchase by the consumer. 

Under this commercial guarantee, ENGINO guarantees that the covered product will maintain its required functions and performance during normal use, when used, handled and stored in accordance with the product instructions and its intended purpose. 

This commercial guarantee is provided free of charge.

2. Statutory Consumer Rights

This commercial guarantee is additional to, and does not replace or restrict, any rights that consumers may have under applicable consumer protection legislation. 

Consumers are entitled by law to remedies from the seller, free of charge, where goods do not conform to the sales contract. These statutory rights are not affected by this ENGINO commercial guarantee. 

3. Products Covered

Unless specifically stated otherwise, this commercial guarantee applies to ENGINO products identified as being covered by the ENGINO 3-Year Commercial Guarantee. 

Where a product is covered by the guarantee, the guarantee applies to the complete product supplied by ENGINO, subject to the exclusions and conditions stated below. 

4. What Is Covered

The guarantee covers defects or failures occurring during the guarantee period where, under normal and intended use, the product fails to maintain its required functions or performance. 

Depending on the nature of the defect, ENGINO may: 

  • repair the defective product; 
  • replace the defective product; 
  • replace the defective component where this restores the complete product to proper operation 

Any repair or replacement under this guarantee will be provided without charge to the consumer for the covered defect.

5. Normal Use

For the purposes of this guarantee, normal use means use of the product: 

  • for its intended purpose; 
  • in accordance with the instructions, warnings and specifications supplied with the product; 
  • with compatible ENGINO equipment or other equipment meeting the specifications stated by ENGINO; 
  • within the operating conditions for which the product was designed; and 
  • with reasonable care appropriate to the nature of the product. 

Normal wear resulting from reasonable use does not by itself constitute a defect unless it causes the product to fail to maintain the durability guaranteed by ENGINO.

6. What Is Not Covered

This commercial guarantee does not cover failure or damage resulting from circumstances other than normal use, including:

  • Misuse or abuse


    Improper, excessive or unintended use.

  • Accidental damage


    Dropping, impact or excessive force.

  • Liquid or environmental damage


    Water, moisture, heat, fire, chemicals or other conditions not suitable for the product.

  • Incorrect electrical use


    Incorrect voltage, polarity, power supplies or wiring outside specifications

  • Motor abuse or abnormal loading


    Operation outside intended conditions, excessive loading or blocked rotation.

  • Unauthorized modification or repair


    Opening, dismantling or altering the product by an unauthorized person.

  • Use with unsuitable components


    Incompatible accessories or materials.

  • Failure to follow instructions


    Not following operating, assembly or safety instructions.

  • Loss of parts


    Parts lost after opening and using the product are not considered a defect.

  • Intentional damage


    Damage caused deliberately or through negligence.

8. Making a Guarantee Claim

To make a claim, the consumer should contact ENGINO or the relevant seller and provide, where reasonably available: 

  • proof of purchase showing the purchase date; 
  • product name or product code; 
  • description of the problem; 
  • photographs or video demonstrating the issue where appropriate; and 
  • any other information reasonably necessary to identify and assess the product and claimed defect. 

For certain claims, ENGINO may request that the affected product or component be returned for inspection. 

The consumer should not dismantle or further modify the affected component for the purpose of demonstrating the defect unless instructed by ENGINO. 

9. Assessment of Claims

ENGINO will assess claims based on the information available, including the nature of the failure, condition of the product, information supplied by the consumer and, where appropriate, physical inspection or testing. 

Where ENGINO determines that the failure is not covered by the commercial guarantee, the consumer will be informed of the reason for that decision. 

A claim will not be rejected merely because the product shows ordinary evidence of having been used.

10. Repair or Replacement

Where a valid guarantee claim is confirmed, ENGINO will provide repair or replacement as appropriate. 

Where only one component has failed and replacing that component restores the entire product to its required functions and performance, ENGINO may replace that component rather than replacing the complete set. 

A replacement may be the same product or component or, where the original is no longer available, an equivalent product or component with comparable functionality. 

11. Missing Parts

Parts that were missing from a sealed product when originally supplied should be reported to ENGINO as soon as reasonably possible after discovery. 

Where ENGINO confirms that a part was missing from the original package, the appropriate replacement part will be supplied in accordance with ENGINO's applicable customer service procedure. 

Parts subsequently lost by the consumer are not considered defects under this commercial guarantee. 

 

12. Proof of Purchase and Guarantee Period

The 3-year guarantee period begins on the original date of purchase. 

ENGINO may request reasonable proof of the purchase date, such as an invoice, receipt or other reliable purchase record. 

Where the purchase date cannot reasonably be established, ENGINO may use other available information to determine whether the product falls within the guarantee period, to the extent permitted by applicable law.

 

13. Transfer and Resale

Unless applicable law requires otherwise, the guarantee applies to eligible ENGINO products during the stated guarantee period regardless of a subsequent change of ownership, provided that the original purchase date can be reasonably established.

 

14. Geographical Application

These terms apply to ENGINO products for which the ENGINO 3-Year Commercial Guarantee is offered to consumers. 

Any mandatory rights provided by the law of the country in which the consumer resides remain unaffected.

 

15. Guarantor

The producer and guarantor for this commercial guarantee is:

16. Important Notice

The ENGINO 3-Year Commercial Guarantee is a voluntary commercial guarantee offered in addition to consumers' statutory rights. 

Nothing in these Terms and Conditions limits or excludes any legal guarantee of conformity or other mandatory consumer rights available under applicable European Union or national law.
